Terms & Conditions

  1. The VitaHealth Spend & Win A Vacation Contest [“Contest”] is organised by VitaHealth Malaysia Sdn. Bhd. (534481-V), [the “Organiser”].
  2. By participating in the Contest, the Participant is deemed to have fully and unconditionally agreed to be bound by the Terms and Conditions stated hereinafter. The Organiser reserves the right to amend the Terms and Conditions at any time without prior notice.
  3. The Contest will run from 0:00:00am on 1 August 2024 to 23:59:59pm on 30 September 2024 (“the Contest Period”). The Organiser reserves the right at its absolute discretion to vary, postpone, re-schedule and/or extend the Contest Period and/or cancel/terminate the Contest at any time without prior notice. All entries received outside the Contest Period shall be automatically disqualified.
  4. Participants are required to complete the following steps to participate in the Contest:
    1. Spend a minimum of RM138 on any VitaHealth products at BIG Pharmacy within Contest period.
    2. Snap a photo of receipt as the proof of purchase (“POP”).
    3. Submit entry.
  5. The Contest is valid for minimum purchase of RM138 on any VitaHealth products at any BIG Pharmacy outlets.
  6. The Contest is valid for receipts within Contest Period: 1 August – 30 September 2024.
  7. Each POP is eligible for one [1] entry only. The Participant may submit multiple entries if there are more than 1 POP. The Organiser shall have the right to disqualify entries where: a) the POP submitted is a duplicate, incorrect, unclear and/or damaged; and/or b) the required details are not provided, incomplete, illegible, unclear and/or inaccurate.
  8. The Organiser reserves the right to request for evidence of the original POP and identification document for verification. Failure to produce the POP upon request will result in disqualification and Prize forfeiture.
  9. The Organiser reserves the right to disqualify or reject, at its sole and absolute discretion, any entries if:
    1. the Participant is not eligible in accordance to the Terms and Conditions herein stated;
    2. the entries are incomplete and/or failure to comply with any of the Terms and Conditions;
    3. the Participant breaches any of the Terms and Conditions or other rules and regulations of the Contest or violates any applicable laws or regulations;
    4. the Participant has undermined or tampered or attempted to undermine or tamper the operation or process of the Contest in any way whatsoever, including but not limited to fraud, cheating or deception;
    5. the entries contain third party intellectual property rights that are used without prior consent from the rights holder;
    6. the entries contain obscene, profane, vulgar, abusive, hateful, threatening, harassing, offensive or otherwise inappropriate language, imagery or material, including without limitation any message/image which contains (a) swearing; (b) comments or actions which appear to be discriminatory of any person, company or group of individuals, for example, comments of a racist, sexist or homophobic nature; (c) sexual innuendo, sexual language or sexual acts, actions or gestures; (d) promoting any illegal unlawful activity such as drug use; (e) any message/image that appears to be an advertisement or solicitation to buy; and (f) any materials (whether written or visual) that directly or indirectly relate to VitaHealth competitors or that show any intention of promoting any brand other than VitaHealth; or
    7. The profile is removed or deleted within the winner selection or contact process.
  10. Multiple entries are allowed, however, each Participant is only entitled to win one (1) Prize according to their registered Malaysian Identification Card Number.
  11. Winners will be selected through lucky draw system, either by means of manual or computerised in any method as the Organiser may determine at its absolute discretion. The Organiser shall reserve the right, at its absolute discretion, to review and vary the Winners’ selection process contained herein at any time without prior notice.
  12. By participating in the Contest, the Participants agree and acknowledge that all intellectual property rights thereto shall belong to the Organiser and you consent to the collection, use, processing and/ or disclosure by the Organiser any and all of your personal information including without limitation your name and Photo for purposes of the Contest, including advertising, publicity, marketing and promotional activities of any goods or services of the Organiser, for an unlimited time in any media and without compensation and notification. Participants shall not be entitled to claim ownership and/or other forms of compensation on the materials.
  13. The Organiser’s decisions on all matters relating to the Contest, including without limitation, the determination of the Winners, and/or in every situation including any not covered in these Terms and Conditions, shall be final and binding on all participants in the Contest. No queries, themes or appeals may be made or entertained regarding the Organiser’s decision on the same. The Participants shall not dispute nor make any oral or written complaints, public announcements, or statements on the same during or after the Contest Period.
  14. The Contest Prizes are:
    1. 1X Grand Prize: 5D4N Cruise on Anthem of the Seas by Royal Caribbean (2 pax with Balcony Cabin)
    2. 1X 1st Prize: 3D2N stay at Hard Rock Hotel, Penang (1 room)
    3. 1X 2nd Prize: 2D1N stay at Thistle Port Dickson Resort (1 room)
  15. Each Participant may only win one [1] Prize throughout the Contest Period. All Prizes are not returnable or exchangeable for cash. The Organiser reserves the right to select an alternative winner in the event that the Organiser has reasonable grounds for believing that a selected winner has violated any of these Terms and Conditions.
  16. Winners will be notified via phone or email or mail or such other communication methods deem fit to the Organiser within 2 weeks after winner announcement. The Organiser will not be held liable in the event of non-receipt or delayed delivery of any form of notification to the winners.
  17. Winners are required to contact with appointed travel agency to redeem the prizes.
  18. The terms & conditions for each Prize are as below:
    1. 1X Grand Prize: 5D4N Cruise on Anthem of the Seas by Royal Caribbean (2 pax with Balcony Cabin)
      1. The Anthem of the Sease Cruise departing from Singapore on 10 December 2024.
      2. The Cruise will stop at Penang, Phuket and returning to Singapore on 14 December 2024.
      3. Winners are required to pay related visa fee, port charges, gratuities, self-transportation to and from Cruise terminal at Singapore and any other incidental charges if applicable.
    2. 1X 1st Prize: 3D2N stay at Hard Rock Hotel, Penang (1 room)
      1. The stay is valid from 15 – 30 November 2024. The redemption of the prizes is subjected to blackout dates and availability. The prizes are not exchangeable for cash.
      2. Winners are required to pay self-transportation to and from the hotel and any peak season surcharge if applicable.
      3. Visual(s) of the prize shown in any advertisement, promotional publicity and other materials relating to this Contest are solely for illustration purposes only and may not depict the actual prize.
    3. 1X 2nd Prize: 2D1N stay at Thistle Port Dickson Resort (1 room)
      1. The stay is valid from 15 – 30 November 2024. The redemption of the prizes is subjected to blackout dates and availability. The prizes are not exchangeable for cash.
      2. Winners are required to pay self-transportation to and from the hotel and any peak season surcharge if applicable.
      3. Visual(s) of the prize shown in any advertisement, promotional publicity and other materials relating to this Contest are solely for illustration purposes only and may not depict the actual prize.
  19. The Organiser reserves the right to extend the timelines stated under this clause owing to reasons beyond the control of the Organiser.
  20. All unclaimed Prizes after the deadline 30 October 2024 will be forfeited.
  21. The Contest Prizes are not exchangeable for cash or other deals or goods or credit of any kind. The Organiser reserves the right at its absolute discretion to substitute any of the Prizes with alternative Prizes or similar value at anytime without prior notice.
  22. The Prizes are given on an “as is” basis and are accepted by the Winners without warranty or guarantee of any kind, whether express or implied.
  23. All transportation, accommodation, personal costs and/or any other costs, fees and/or other expenses that are incurred to participate in the Contest and to redeem the Contest Prize is at the sole responsibility of the winners.
  24. By participating in the Contest or accepting the Prizes, the Participants agree that no claim relating to such losses or injuries (including special, indirect and consequential losses) shall be asserted against the Organiser from any and all losses, damages, rights, claims and actions of any kind resulting from the Contest and acceptance of any Prize, including without limitation, personal injuries, death and property damage.
  25. All Participants hereby warrant that all personal data given is true, correct, accurate and complete. The Personal Data will be recorded, stored or otherwise processed for purposes relating to the administration of the Contest and for related advertising, publicity, marketing and our other legitimate business purpose. The Organiser may also use the Participants’ personal data for purposes of contacting and sending to you marketing and promotional information or materials about the products, services, any promotions, events or Contests organised by the Organiser.
  26. To the extent that the applicable law allows, you have the right to request access to, request for a copy of, request to update or correct, your personal data held by the Organiser.   27. The Contest Terms and Conditions may be amended from time to time and shall prevail over any provisions or representations contained in any other promotional material or advertising of the Contest. Participants are highly advised to visit the Organiser’s website from time to time to ensure that the Participants are aware of any updates and changes made.
  28. By participating in the Contest, the Participants are deemed to have read, understood and agreed to the Contest Terms and Conditions, Personal Data and Privacy Policy.
